Basic requirements for Permanent residence

  1. Must be of good character
    Must comply with the law and exhibit good behavior as a resident in their daily life.
  2. Must possess sufficient assets or skills to earn an independent living
    Must not be a burden to the public in daily life, and must be expected to be financial stable based on their assets and/or skills.
  3. It is recognized that permanent residence would be in the interests of Japan
    1. The applicant must have, in principle, resided in Japan continuously for at least 10 years. However, they must have been residing for at least five of those years with a work-related or residential status of residence (excluding the “Technical Intern Training” and “Specified Skilled Worker (i)” statuses of residence).
    2. (2) The applicant must never have been sentenced to fines or imprisonment and must properly perform their public duties (such as paying taxes, public pension, and public medical insurance premiums, along with submitting notifications as prescribed by the Immigration Control and Refugee Recognition Act).
    3. (3) The applicant must be residing in Japan with the longest period of stay possible for their current status of residence( 3 years or 5 years).
    4. (4) There must be no risk of harm from a public health perspective.

・ If the applicant is the spouse or child of a Japanese national, permanent resident, or special permanent resident, they are not required to conform to points 1 or 2. If the applicant is recognized as a refugee, they are not required to conform to point 2.

Exceptions to the ten-year residency requirement

As stated above, as a general rule, the applicant must have resided in Japan continuously for at least 10 years, of which at least the last 5 years must have been spent in Japan with work or residence status. However, the following special exceptions are allowed.

Exceptions for Highly Skilled Professional:
  • Those whose current status of residence is HSP(Highly skilled professional) (70 points or more)
    (Must have resided in Japan for at least three years)
  • Those whose current status of residence is HSP(Highly skilled professional) (80 points or more)
    (Must have resided in Japan for at least one year)
  • Those whose current status of residence is other than HSP(Highly skilled professional), such as ‘Engineer/Specialist in humanities/International services’, ‘Intra-company transferee’ or ‘Business Administration’, can also apply for permanent residence if they had 70 points or more at the time of application and three years ago (one year ago is sufficient if they had 80 points or more).
  • Those who have been continuously residing in Japan as a ‘Special Highly skilled professional (J-Skip)’ for more than one year
  • Those whose current status of residence is other than ‘Special Highly skilled professional (J-Skip)’, but who have fulfilled the requirements for ‘Special Highly skilled professional (J-Skip)’ for one year prior to applying for permanent residence.
Exceptions for spouses of Japanese nationals, permanent residents, and special permanent residents
  • Spouses of Japanese nationals, permanent residents and special permanent residents:
    The marriage must have lasted for at least three years and the spouse must have resided in Japan for at least one year.
  • Children of Japanese nationals, permanent residents and special permanent residents:
    The child must have resided in Japan for at least one year.
Exceptions for “Long-Term Resident”(Teijyu-sha)

Applicants with the “Long-Term Resident” status of residence must have resided in Japan continuously for over five years.
